This Privacy Policy (hereinafter referred to as the “Policy”) regulates the procedure for collecting, processing, storing, using, disseminating and protecting personal data of visitors to the website www.perimfund.org, Benefactors, partners, volunteers, beneficiaries and other persons who interact with the Charitable Organization “PERIMETER Charitable Foundation”.

1. General provisions

1.1. This Policy is designed to inform data subjects about the processing of their personal data by the Foundation, as well as to ensure the protection of such data during processing.

1.2. In this Policy, the terms are used in the meaning defined by the Law of Ukraine “On Personal Data Protection” and other acts of current legislation of Ukraine.

1.3. This Policy applies to personal data that the Foundation receives when visiting and using the website www.perimfund.org, making charitable donations, subscribing to updates, filling out feedback forms, correspondence, telephone communication, cooperation with the Foundation, or other interaction with the Foundation.

1.4. The Fund has the right to entrust the processing of personal data in whole or in part to third parties on the basis of a contract and in accordance with the requirements of the current legislation of Ukraine.

1.5. Posting this Policy on the Foundation’s website is a notification to personal data subjects about the personal data controller, the composition and content of personal data, the purpose of their collection, the rights of personal data subjects and persons to whom such data may be transferred.

2. What personal data may the Foundation process?

2.1. The Foundation may collect and process personal data that a person voluntarily provides to the Foundation, including: last name, first name, patronymic; email address; phone number; payment details; amount and purpose of the charitable donation; information specified in feedback forms, applications, letters or messages.

2.2. When you visit the website, the Foundation or third parties whose services are used on the website may automatically collect technical information, including IP address, browser type and version, device type, operating system, browser language, date and time of visit to the website, pages viewed, source of referral to the website, as well as information obtained using cookies.

2.3. If a person makes a charitable donation through payment services, banks, or other payment instruments, the Foundation may receive information necessary for recording the payment, confirming receipt of funds, accounting and financial accounting, reporting, and compliance with legal requirements.

2.4. The Foundation does not carry out targeted processing of special categories of personal data, in particular data on racial or ethnic origin, political, religious or philosophical beliefs, membership in political parties and trade unions, data on health, sex life, biometric or genetic data, except in cases where such processing is expressly provided for by law or is necessary for the implementation of charitable assistance and is carried out on lawful grounds.

3. Purpose of processing personal data

3.1. The Foundation processes personal data for the purpose of carrying out its statutory activities, ensuring the operation of the website, accepting and accounting for charitable donations, communicating with Benefactors, partners, volunteers and other persons, preparing reports, fulfilling the requirements of the legislation of Ukraine and protecting the rights and legitimate interests of the Foundation.

3.2. Personal data may be used, in particular, for: processing applications and requests; making charitable payments; identifying payments; sending information messages about the Foundation’s activities, charitable projects, reports and fees; maintaining accounting, tax and management records; ensuring site security; improving the operation of the Foundation’s site and communications.

3.3. The Foundation does not use personal data for purposes incompatible with this Policy, the Foundation’s Charter, or the current legislation of Ukraine.

4. Legal basis for processing personal data

4.1. The Fund processes personal data on the following legal grounds: consent of the personal data subject; necessity to conclude or perform a transaction; fulfillment of legal requirements; implementation of the statutory activities of the Fund; legitimate interest of the Fund, unless such interest overrides the rights and freedoms of the personal data subject.

4.2. In cases where personal data is processed on the basis of consent, such consent may be withdrawn by the subject of personal data in accordance with the procedure specified in this Policy and the legislation of Ukraine.

6. Transfer of personal data to third parties

6.1. The Foundation may transfer personal data to third parties only in cases provided for by this Policy, the current legislation of Ukraine, or with the consent of the personal data subject.

6.2. Personal data may be transferred to banks, payment services, providers of technical, hosting, analytical, communication, legal, accounting or other services if such transfer is necessary for the activities of the Fund, the operation of the site, making payments, reporting or fulfilling legal requirements.

6.3. The Foundation may transfer personal data to state bodies, courts, law enforcement agencies or other authorized persons in cases and in accordance with the procedure provided for by the current legislation of Ukraine.

6.4. The Foundation does not sell personal data to third parties.

7. Publication of information about benefactors and proceeds

7.1. The Foundation may publish information on the website, in reports, social networks, or other official communication channels about charitable donations received, implemented projects, and overall performance results.

7.2. Publication of the Benefactor’s personal data, in particular the name, surname or other identifying information, is carried out if there are legal grounds, the consent of the Benefactor, or if such information has already been voluntarily provided for public posting.

7.3. In public reporting, the Fund may use generalized, depersonalized, or partially hidden information about revenues and expenses.

7.4. In cases where disclosure of information may pose risks to the safety of military personnel, beneficiaries, partners, volunteers, or other persons, the Foundation has the right to limit the detail of such information.

8. Personal data retention period

8.1. Personal data is stored for the period necessary to achieve the purpose of their processing, fulfill contracts, record charitable donations, prepare reports, protect the rights and legitimate interests of the Foundation, as well as for the periods provided for by the current legislation of Ukraine.

8.2. Personal data may be deleted or destroyed upon expiration of their storage period, termination of the legal relationship between the subject of personal data and the Fund, withdrawal of consent to the processing of personal data, if there are no other legal grounds for their processing, or in other cases provided for by the legislation of Ukraine.

9. Protection of personal data

9.1. The Foundation takes organizational, legal and technical measures to protect personal data from unlawful processing, accidental loss, destruction, damage, unauthorized access, dissemination or other unlawful use.

9.2. Access to personal data is provided only to those individuals who need it to perform their duties or provide services to the Foundation.

9.3. The Foundation cannot guarantee the absolute security of information transmission over the Internet, but takes reasonable measures to mitigate the relevant risks.

10. Rights of personal data subjects

10.1. The subject of personal data has the rights provided for by the Law of Ukraine “On Personal Data Protection”, in particular the right to know about the sources of collection, the location of their personal data, the purpose of their processing, the location of the personal data controller, to receive information about the conditions of access to personal data, to have access to their personal data, to submit a reasoned request to object to the processing of personal data, to demand the change or destruction of personal data if they are processed illegally or are inaccurate, to withdraw consent to the processing of personal data and to exercise other rights specified by law.

10.3. The subject of personal data also has the right to address issues of personal data protection to the Commissioner for Human Rights of the Verkhovna Rada of Ukraine.

11. Information messages

11.1. The Foundation may send newsletters, news, reports, inquiries, thank-you notes, invitations, or other communications to individuals who have provided their contact information to the Foundation, subscribed to updates, made a charitable donation, or otherwise interacted with the Foundation.

11.2. A person may refuse to receive informational messages by contacting the Fund at info@perimfund.org or using another available unsubscribe method, if provided by the relevant service.

12. Changes to the Policy

12.1. The Foundation has the right to review and change this Policy at any time.

12.2. The current version of the Policy is posted on the Foundation’s website: www.perimfund.org.

12.3. The new version of the Policy comes into force from the moment it is posted on the Foundation’s website, unless otherwise specified in the Policy itself.
